Acceptance

By downloading, installing, or using the Shimpaku app, or by using this website, you agree to these Terms of Use. If you do not agree, please do not use the app or this website.

License

Finiks Labs LLC grants you a personal, non-commercial, non-transferable license to use the Shimpaku app on devices you own or control, for as long as you comply with these terms.

No warranty

Shimpaku is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, reliability, or uninterrupted operation.

Not a medical or health product

Shimpaku is a focus timer. It is not a medical device, a health product, or a substitute for professional medical or psychological advice. Use your own judgment about how it fits into your day.

Your progress can be lost

Your settings, tree, and session history live only on your device. Changing phones, uninstalling the app, or a device failure can permanently erase this progress. Finiks Labs LLC is not responsible for lost progress, since there is no account or server-side copy to restore it from.

Intellectual property

The Shimpaku name, the bonsai illustrations, the garden artwork, and the app's code are the property of Finiks Labs LLC. Nothing in these terms transfers ownership of that material to you.

Limitation of liability

To the fullest extent permitted by law, Finiks Labs LLC is not liable for any indirect, incidental, or consequential damages arising from your use of the app or this website. In no event will our total liability to you exceed the amount you paid for the app, which is zero, since Shimpaku is free.

Some jurisdictions do not allow these limitations, in which case they apply to the fullest extent permitted by law in your jurisdiction.

Changes

We may change the app or these terms over time. If we make material changes to the terms, we will update the effective date above.

Termination

You may stop using the app at any time by uninstalling it. We may discontinue the app or any part of it at our discretion.

Governing law

These terms are governed by the laws of the jurisdiction where Finiks Labs LLC is established, without regard to conflict-of-law principles.

App store terms

Your use of the app is also subject to the standard terms of the store you downloaded it from — Apple's Licensed Application End User License Agreement, or the Google Play Terms of Service, as applicable.
